Branchsight Bilgi Teknolojileri Anonim Şirketi (“Branchsight”, “we”, “us”, “our”) attaches great importance to the privacy of its visitors and users. Accordingly, this Branchsight Personal Data Protection Clarification Text (“Clarification Text”) explains how Branchsight and its affiliates collect, use, and share your personal data, as well as your rights over your personal data in your capacity as a data subject. This Clarification Text applies to all Branchsight users (collectively “Users”, “you”, “your”), regardless of whether you are registered with Branchsight, which package you are registered with, or whether you use our web/mobile applications. We kindly request you to carefully read the User Membership Agreement (“Agreement”) written below before initiating the Branchsight service. If any of the terms specified in the Agreement are not suitable for you, please do not utilize this service. Signing this Agreement means that you accept the terms written on these pages in advance.

1. Which Personal Data Do We Collect?

1.1. User Data: Personal data refers to any data belonging to an identified or identifiable real person (“Personal Data”), and there are certain key personal data that we must process in order to provide you with a good service. We collect and process your Personal Data directly from you, through your use of the services, and via other third-party sources. The personal data we collect from you is as follows:

1.2. Data we receive directly from you: If you register with Branchsight, benefit from any of our services, and/or contact us directly or indirectly through any communication channel, your first name, last name, email address, and phone number are collected. In order for you to benefit from paid services, your payments are collected through third-party service providers; within this scope, information regarding the first 6 (six) and last 4 (four) digits of the debit/credit card you have provided is stored.

1.3. Data obtained through your use of the services: If you benefit from, download, and/or use any of our services, we may collect non-identifying aggregate usage data such as your device, operating system, internet browser, screen resolution, language and keyboard settings, location, internet service provider, referring and exit pages, date and time stamps, browsing and clicking activities, session heatmaps, and scrolls.

1.4. Data collected from third-party sources: For example, we may receive Personal Data belonging to you from:

  • (i) security service providers and fraud detection and prevention service providers who help us detect Users engaged in fraudulent activities;

  • (ii) social media platforms—when you log in or register with your social media account, we may receive your Personal Data (such as your username and basic profile info) from that service—and, in some cases, companies providing lead identification services that help us improve the services we offer;

  • (iii) third parties such as our advertising and marketing partners with whom we cooperate to track, manage, and measure our advertising campaigns.

2. For Which Purposes Do We Process / Use Your Personal Data?

We process your Personal Data for the following purposes:

  • 2.1. To fulfill the provisions of the agreements executed or to be executed with you,

  • 2.2. When our use of your Personal Data is necessary to fulfill a relevant legal obligation or an obligation mandated by a regulatory body,

  • 2.3. To protect the legitimate interests of Branchsight, provided that it does not violate your fundamental rights and freedoms,

  • 2.6. To provide uninterrupted customer and technical support to Users,

  • 2.8. To update, expand, and analyze our records to identify potential new customers,

  • 2.9. To provide and sponsor specific events and promotional opportunities, determine the eligibility of participants for these events, track their performance, and communicate with them,

  • 2.10. To ensure the security of your data and prevent fraud,

  • 2.11. To comply with all relevant laws and regulations, primarily the Personal Data Protection Law No. 6698 (“KVKK”).

3. With Which Third Parties and For What Purposes Do We Share Your Personal Data?

We may share or grant access to your Personal Data with service providers and others in the manners and circumstances specified below:

3.1. Third-Party Service Providers: Branchsight partners with a number of selected service providers whose services and solutions complement, facilitate, and support our own. These services and solutions include hosting and server co-location services, communications, content delivery networks (CDNs), data security and cybersecurity services, billing and payment processing services, design/advertising services, fraud detection and prevention services, web analytics, email distribution and tracking services, session recording and remote access services, performance measurement, data optimization, marketing services, content providers, as well as Branchsight’s legal and financial advisors.

3.2. Enforcement of Laws: Branchsight may transfer or grant access to your Personal Data to official authorities, with or without notice to you, pursuant to a legal request such as a subpoena, legal proceeding, search warrant, or court order, or in cases mandated by the Personal Data Protection Law and/or other relevant legislation.

3.3. Social Media Features and Framed Pages: Our Services harbor certain Social Media features, widgets, and single sign-on features ("Social Media Features") such as "Connect with Facebook" or "Log in with Google" features, the "Like on Facebook" button, the "Share This" button, and other interactive mini-programs. These Social Media Features may collect certain Personal Data, such as your IP address and which page you are visiting on our Website, and may set a cookie to enable them to function properly. Social Media Features are hosted either by a third party or directly on our Services. Your interactions with these third-party Social Media Features are governed by the policies of those third parties, not ours, and we recommend that you review the relevant third-party policies when utilizing such services.

3.4. The use and transfer to any other application of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

3.5. In the Event of a Change in Control of Branchsight: If any change occurs in the control of Branchsight or any of its affiliates, including changes resulting from a merger, acquisition, or purchase of substantially all of its assets, your Personal Data may be shared with the parties involved in such event.

3.6. Upon Your Instruction: Branchsight may also share your Personal Data with third parties for other purposes upon your instruction or explicit consent.

4. Your Rights Regarding Your Personal Data (Rights of the Data Subject)

As a data subject, if you submit your requests regarding the rights listed below to us, your request will be concluded free of charge, through written or secure electronic communication channels, as soon as possible and within thirty days at the latest, depending on its nature and following identity verification. Since it is important that the personal data we hold about you is accurate and up-to-date, it is crucial that you notify our Company when a change occurs in your personal data. As the data subject, you have the right to:

  • 4.1. Learn whether your personal data is processed,

  • 4.2. Request information if your personal data has been processed,

  • 4.3. Learn the purpose of processing your personal data and whether they are used in accordance with their purpose,

  • 4.4. Know the third parties to whom personal data is transferred domestically or abroad,

  • 4.5. Request rectification of personal data if it is processed incompletely or inaccurately, and request notification of the transaction made within this scope to the third parties to whom the personal data has been transferred,

  • 4.6. Request the erasure or destruction of personal data in the event that the reasons requiring its processing cease to exist, despite being processed in accordance with the provisions of Law No. 6698 and other relevant laws, and request notification of the transaction made within this scope to the third parties to whom the personal data has been transferred,

  • 4.7. Object to the occurrence of a result against yourself by analyzing the processed data exclusively through automated systems,

  • 4.8. Claim indemnification for the damage in case you suffer damage due to the unlawful processing of personal data.

Within the scope of KVKK, you may submit your requests regarding your rights with documents verifying your identity and your petition containing your request to our address at Esentepe Mah. Talat Paşa Cad. No:5 İç Kapı No:1 Şişli / İstanbul personally in person or via a notary public, to our KEP address with a secure electronic signature or mobile signature, or by using your electronic mail address previously notified to Branchsight and registered in our system.

5. Third-Party Websites

Our Services may contain links to other websites and services. Branchsight is in no way responsible for the privacy practices of these websites and services. We encourage you to be aware when you leave our website and to read the privacy policies and clarification texts of each and every website and service you visit before providing your Personal Data. This Clarification Text applies solely to Branchsight and its affiliates, and is not applicable to third-party websites and services.

6. Updates

We may update this Clarification Text in accordance with KVKK and/or other relevant laws and to reflect changes in our Personal Data collection, use, and storage practices. When the Clarification Text is updated, we will notify you, request your explicit consent, and/or fulfill all other obligations as required by KVKK and/or other relevant laws. We recommend that you review this page at regular intervals for the latest information on our privacy practices. Unless stated otherwise, our most current Clarification Text applies to all personal data we hold regarding you in the context of our Website, Mobile Application, and other services.
